Conflicto de competencia suscitado entre el Juzgado Segundo de Familia de Pasto y el Juzgado Segundo Civil del Circuito de Facatativá.
La controversia se generó en torno a las diferentes interpretaciones que del factor territorial hicieron las autoridades judiciales involucradas.
Teniendo en cuenta que ambos despachos son competentes para tramitar la acción de tutela, la Corte decide respetar la elección que hizo el accionante y dispone que quien debe dar trámite a la misma es el Juzgado de la ciudad de Pasto, a quien se le envía el expediente para que de manera inmediata tramite y adopte la decisión de fondo que corresponda.
